1. License Grant
By downloading this free version of the one-shot kit ("WELCOME One Shot Kit"), you ("Licensee") are granted a non-exclusive, non-transferable license to use the sounds, music, and any other included content ("Content") under the terms outlined in this agreement.
Personal and Commercial Use: Licensee may use the Content in personal and commercial projects, including but not limited to films, games, and audio productions.
Geographic Limitation: The license granted hereunder is valid worldwide.
Duration: The license is perpetual, subject to the conditions of this agreement.
2. Prohibited Uses
Resale and Redistribution: Licensee may not resell, redistribute, sublicense, or otherwise make the Content available to third parties in its original or modified form.
Modification: Licensee may modify the Content for use in their projects but may not distribute the modified Content as standalone assets.
Copyright Infringement: Licensee may not use the Content in any manner that infringes upon the rights of third parties or violates any laws.
3. Attribution Requirements
Credit: No attribution is required for the use of this Kit in Licensee’s projects. However, if Licensee chooses to give credit, it should be in the following format: "WELCOME One Shot Kit by WelcomeCarson".
4. Liability
Warranty Disclaimer: The Kit is provided "as is" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: In no event shall WelcomeCarson be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Content, even if advised of the possibility of such damages.
Indemnification: Licensee agrees to indemnify and hold harmless WelcomeCarson from any claims, losses, damages, liabilities, including legal fees, arising out of Licensee’s use of the Content in violation of this agreement.
5. Termination
Conditions for Termination: This license is automatically terminated if Licensee breaches any of the terms and conditions contained herein.
Effects of Termination: Upon termination, Licensee must immediately cease all use of the Content and destroy any copies of the Content in Licensee’s possession or control.
6. Updates to the Kit
Notification of Updates: WelcomeCarson reserves the right to update or modify the Kit at any time without prior notice.
Access to Updates: Licensee will not have access to updates or modifications unless specifically provided by WelcomeCarson.
7. Miscellaneous
Severability: If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: This agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, or representations.
Amendments: This agreement may be amended only in writing and must be signed by both parties.
